These Terms and Conditions (“Terms”) govern your access to and use of the ABCD hosting services, software, and related support (“Service”).
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Definitions

  • Service: The ABCD software, hosting infrastructure, support, tools, and related services provided by ABCDHost.net.
  • User (“You”): Any individual or legal entity who accesses, registers for, or uses the Service.
  • Account: A user profile created to access the Service.
  • Subscription: A paid service plan granting access to the Service during a billing period.
  • Customer Data: Any information, files, content, or personal data submitted, uploaded, or processed by you through the Service.
  • Data Protection Laws: All applicable global privacy laws, including GDPR (EU/EEA/UK), LGPD (Brazil), CCPA/CPRA (USA – California), DPDPA (India), and any other relevant international rules.

2. User Accounts

To use the Service, you must create an Account with accurate, complete, and current information.
Failure to provide accurate information may result in suspension or termination.

You are responsible for:

  • Maintaining the confidentiality of your password;
  • All activities occurring under your Account;
  • Notifying us immediately in case of unauthorized access.

You must be 18 years or older to create an Account.

3. Subscriptions, Payments, and Billing

The Service is provided on a subscription basis (monthly or annual).

  • Billing Cycle: You will be billed in advance on a recurring basis.
  • Automatic Renewal: Subscriptions renew automatically unless canceled.
  • Payment Method: A valid payment method (e.g., credit card) is required. By submitting payment information, you authorize recurring charges.
  • Price Changes: We may adjust subscription fees. You will be notified at least 30 days before new pricing takes effect.
  • Cancellation: You may cancel at any time through your account dashboard or by contacting support. Canceling prevents the next renewal but does not issue refunds unless stated below.

4. Refund Policy

Refunds are handled according to the rules below:

  • Subscription fees are non-refundable, except where required by applicable law (EU, US, Brazil, India, etc.).
  • EU/EEA consumers may have additional withdrawal rights under consumer law.
  • If ABCDHost.net fails to deliver the Service for reasons within our control, you may request a proportional refund.

5. Acceptable Use Policy

You agree not to use the Service for:

  • Illegal purposes or violations of local, national, or international law;
  • Uploading or distributing content that infringes intellectual property or privacy rights;
  • Spreading malware, harmful scripts, or destructive code;
  • Attempting unauthorized access to servers, accounts, or networks;
  • Interfering with or disrupting the Service’s infrastructure;
  • Reselling, sublicensing, or redistributing the Service without written permission.

Violation of this rule may result in the complete removal of your services.

6. Privacy, Data Processing, and Compliance (GDPR, LGPD, CCPA, DPDPA)

Your privacy is important to us. Processing of personal data is governed by our Privacy Policy and, where applicable, our Data Processing Agreement (DPA).

Roles:

  • You act as the Data Controller of Customer Data.
  • We act as the Data Processor, processing Customer Data solely to provide the Service.

For EU/EEA/UK Users (GDPR):

  • Processing is performed under GDPR-compliant terms.
  • Users have rights to access, rectify, erase, restrict, object, and request portability.
  • Cross-border transfers are governed by Standard Contractual Clauses (SCCs).

For Brazil (LGPD):

  • We adhere to LGPD principles, including transparency, purpose limitation, security, and user rights.
  • Data subjects may exercise rights through our contact email.

For California Residents (CCPA/CPRA):

  • We do not sell personal information.
  • California users may request disclosure, correction, or deletion of personal information.

For India (DPDPA 2023):

  • You provide explicit consent for processing.
  • You may withdraw consent at any time, subject to legal retention requirements.

A formal DPA is available upon request.

7. Regional Consumer Rights Notice

Where local consumer protection laws apply (EU, UK, Brazil, India, US states), those rights take precedence over conflicting terms herein, including rights related to:

  • cooling-off periods,
  • refunds,
  • defective services,
  • dispute resolution.

8. Intellectual Property

The Service, trademarks, software, design, and all non-Customer-Data content remain the exclusive property of ABCDHost.net / ABCD Brasil and licensors.

You retain full ownership of your Customer Data.

You grant ABCDHost.net a limited, worldwide, royalty-free license to host, store, transmit, and process your data solely to operate and improve the Service.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

  • ABCDHost.net is not liable for indirect, incidental, consequential, punitive, or special damages, including loss of profits, data, or business.
  • Total liability for any claim shall not exceed the total fees paid by you in the six (6) months preceding the claim.

These exclusions may not apply in jurisdictions where such limitations are restricted (EU consumer law, some US states, Brazil).

10. Termination

We may suspend or terminate your Account without prior notice if:

  • You violate these Terms;
  • Required by law;
  • Your activity threatens the security or integrity of the platform.

Upon termination:

  • Your access to the Service ceases immediately;
  • Customer Data may be permanently deleted after 30 days (or as required by law);
  • You are responsible for exporting any data before deletion.

11. Governing Law and Dispute Resolution

Unless mandatory local laws override this clause:

  • These Terms are governed by the laws of Brazil (ABCD Brasil headquarters).
  • Disputes shall be resolved in the courts of Porto Alegre, Rio Grande do Sul.

For EU and UK consumers, disputes may be brought to local courts as required by consumer law.

12. Changes to These Terms

We may modify these Terms at any time.
If changes are material, we will give at least 30 days’ notice by email or through the Service.

Continued use of the Service constitutes acceptance of the updated Terms.
